Collaborative LawA relatively new development in Colorado divorce law
is an agreed upon procedure for the resolution of divorce issues
known as collaborative law, designed to eliminate adversarial
proceedings so destructive of familial relationships which often
must continue after a divorce. Each party retains collaboratively
trained counsel who, with their respective clients, resolve to
jointly acquire the information necessary and to cooperate in
the resolution of all issues in an equitable manner. Generally
the parties jointly retain a single expert to provide advice in
his or her field: financial issues, the evaluation of property,
parenting plan development or any other issues identified by the
parties requiring expert advice. Thereafter, with the advice of
cooperative counsel and the parties’ designated experts, the parties
anticipate being able to resolve all issues. In the absence of
an amicable agreement, the collaborative procedures are terminated
and new counsel and/or experts may be retained for adversarial
proceedings. |
